Terms and Conditions

1. Acceptance of terms

By creating an account, accessing VineCloud, or using any related services, you agree to these Terms and our Privacy Policy. If you do not agree, you must discontinue use of the service.

2. Service description

VineCloud provides agricultural data capture, mapping, reporting, and collaboration features for growers, advisors, and operational teams.

3. User obligations

• Provide accurate registration and account information.
• Keep login credentials secure and confidential.
• Use the service lawfully and not for fraudulent, abusive, or harmful conduct.
• Ensure data uploaded to the platform does not infringe third-party rights.

4. Fees, billing, and consumer rights

Paid plans are billed according to your chosen package and billing period. Unless otherwise stated in writing, fees are payable in South African Rand and are non-refundable, subject to applicable South African consumer law, including the Consumer Protection Act 68 of 2008 (CPA) where it applies.

5. Intellectual property

All platform software, branding, and content remain the property of Patho Solutions (Pty) Ltd. You receive a limited, non-exclusive, revocable right to use the service in accordance with these Terms.

6. Personal information and data governance

Personal information is processed in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA), read with PAIA and any applicable Regulations, as amended from time to time. Additional details are set out in our Privacy Policy.

7. Availability, security, and incident response

We aim to keep VineCloud available and secure but do not guarantee uninterrupted operation. Planned maintenance, network failure, malicious activity, and third-party service disruptions may affect availability.

8. Limitation of liability

To the extent permitted by South African law, Patho Solutions (Pty) Ltd. is not liable for indirect, consequential, or special damages arising from use of the service. Nothing in these Terms excludes liability that may not lawfully be excluded.

9. Suspension and termination

We may suspend or terminate accounts that breach these Terms, compromise platform security, or create legal risk. You may stop using the service at any time.

10. Third-party services

VineCloud uses third-party infrastructure and integrations, each subject to their own terms:

• Google Play Services
• Google Analytics for Firebase
• Firebase Crashlytics
• TinyMCE
• Cloudlayer

11. Governing law and regulatory framework

These Terms are governed by the laws of the Republic of South Africa, including applicable provisions of the Electronic Communications and Transactions Act 25 of 2002 (ECTA), Consumer Protection Act 68 of 2008 (where applicable), Cybercrimes Act 19 of 2020, and POPIA.

12. Changes to these terms

We may update these Terms from time to time. Material updates will be published on this page with a revised effective date. Continued use of VineCloud after a published update constitutes acceptance of the revised Terms, subject to mandatory rights available under South African law.
